1.01 Under this contract
NV GREEN MOBIL SA which trades under the name
GREEN MOBIL agrees to supply its goods and services to you the customer.
1.02 It is the intention of
GREEN MOBIL that all terms of contract applying to transactions on the www.reva-car.be web site are contained in these Terms and Conditions.
1.03 Green Mobile reserves the right to alter these Terms and Conditions without notice to the customer. Changes will apply to any subsequent orders received.
Payments and delivery
2.01 You will pay us in cash , by Bank Transfer of credit card or debit card (credit card charges apply):
a) the initial non-refundable deposit (if applicable) shown on the order form when you place an order;
b) the balance plus any Extras shown when due (a bank transfer is also acceptable, with cleared funds before registration/delivery);
2.03 You will pay our reasonable charges in respect of:
a) any banking and/or interest charges which are received and/or claimed by us in respect of you breeching this Agreement;
b) letters sent or telephone calls made by us or another person on our behalf as a result of your breach of this Agreement;
c) documents which we or another person on our behalf send to you at your request but to which you have no legal entitlement;
d) any other customer services including changing the terms of this Agreement, which we or another person on our behalf supply to you at your request in connection with the Agreement, and all other expenses (including tracing fees, collection costs and legal costs) that we incur if you break this agreement. Any changes to your Vehicle specification made by you the customer after placement of order will be subject to a Euro 100 plus VAT administration fee.
2.04 We will endeavor to deliver your product as closely as possible to the delivery date on your order form. Delivery dates are estimates only. As many of our products are manufactured and imported from outside the Belgium Green Mobile cannot be held liable for any loses, damages or costs incurred as a result of a change in delivery as stated in 5) below.
2.05 If Green Mobile are unable to register or deliver your Vehicle due to a delay caused by you the customer in documentation, payment or availability then you may be liable for storage costs charged at the prevailing rate.
2.06 You agree you will inspect the product and tell us of any defects within 24 hours of delivery or as soon as is
reasonably possible. If you do not give notice within 24 hours of delivery or as soon as reasonably possible then
the product will have deemed to be delivered in good condition and you will irrevocably and unconditionally waive the rights to reject the goods or claim any damages however caused.
Warranty
3.01 All Green Mobile products are covered by full a manufacturer warranty which is detailed on the
website and available on request.
3.02 Warranty is transferable subject to a successful warranty check by
GREEN MOBIL prior to transfer
Service & Maintenance
4.01 If you have purchased a vehicle from
GREEN MOBIL then you will be required to have it serviced by
GREEN MOBIL at "the intervals recommended by the manufacturer. Failure to do may result in your product warranty becoming void.
GREEN MOBIL provides fully comprehensive servicing and maintenance with a range of options to suit your needs and pocket. All work is performed exclusively by our specially trained engineers, either at your home or office location.
4.02 Servicing is charged annually in advance, servicing fees are non refundable in the event of vehicle disposal or change of ownership. Servicing is transferable in the event of a trade-in from one G-Wiz to another within any 12 month period.
4.03 For mobile servicing a flat driveway or garage on hard ground (not gravel or dirt) away from other moving vehicles with 3 x 3 m of space is required. Car parks and road sides are not suitable for servicing or warranty work.
4.04 Off street parking is needed to charge a REVA-i. Off street parking is defined as all parking areas that are not on a public highway.
Termination of Agreement / Cancellation of Order
5.01 You will be treated as having repudiated this Agreement if you fail to pay any sum due under this agreement within 14 days;
5.02 If you break any term of this agreement we will send you a notice requiring you to put it right. If you do not put it
right within 14 days then we can terminate this Agreement.
5.03 If you are treated as having repudiated this Agreement we can accept the repudiation and terminate this Agreement. You will pay us any money owing at the date of termination.
5.04 Orders for dealer-specified vehicles may be cancelled prior to registration of the vehicle.
5.05 Orders for customer-specified vehicles (built to order) may be cancelled at the discretion of
GREEN MOBIL .
5.06 Deposits are non-refundable. Full terms and conditions of purchase available online and by request
General
6.01 The offer on the attached Agreement is valid under normal circumstances for 14 days from the date shown on the agreement, but may be withdrawn without notice by
GREEN MOBIL .
6.02 Prices are subject to change without notice.
6.03 We shall not be liable or responsible for any direct or indirect losses, costs, damages or loss of profit incurred by you or others if the delivery of your product is delayed, or during service or repair of your product, or any delay in servicing or repairs, or in the event of any breakdown, or as a result of the condition or functioning of the product, or your inability to use it.
6.04 Your rights under this Agreement will not be affected by any forbearance or concession made by us to you.
6.05 In negotiations for this Agreement only persons expressly authorised in writing by us have authority to act as our agent. All the terms agreed between us (except terms included by law) are set out in this Agreement.
6.06 You will not assign this Agreement.
6.07 Severability. If any provision of this Agreement should be held to be invalid it shall to that extent be severed and
the remaining provisions shall continue to have full force and effect.
6.08 Governing Law. This Agreement shall be construed in accordance with the laws of Belgium and shall
be subject to the exclusive jurisdiction of the Belgium courts.
6.9 Green Mobil is the trading name of
NV GREEN MOBIL SA. The registered office address is available here. The
VAT number is BE 0892.250.342
6.10 Your statutory rights as a consumer are not affected by the limitations of this agreement.
Colours
7.01 If choosing a non standard color I understand and accept that:
a) I need to visit
GREEN MOBIL offices to choose the color
b) color samples can look slightly different when on a larger area than the sample (i.e. on the vehicle ordered)
c) Paint finishes (solid, metallic and pearl) can look different depending on the light source (fluorescent, sunlight etc).
Trade-Ins
8.01 A REVA-i may be accepted at the discretion of
GREEN MOBIL as part payment for this order on condition that:
i) A Valuation has been completed by
GREEN MOBIL
ii) The Valuation has been accepted by you in writing
iii) If the trade-in vehicle is not kept on
GREEN MOBIL 's premises after valuation it is your responsibility to return the REVA-i to
GREEN MOBIL in the same condition when requested.
Usage
9.01 Reva-i are sold on the condition that they are not used for the commercial rental or taxi hire purposes.
Personal Data
10.01 You recognize that your personal data has been given to us for the purposes of ordering a
GREEN MOBIL product and providing you with confirmation of that order; providing and developing ancillary services and facilities; direct marketing (subject to your right to withdraw your authority); accounting, billing and auditing; checking credit or other payment cards; security, administrative and legal purposes; systems testing, maintenance and development; statistical analysis; ensuring our compliance with legal and regulatory obligations applicable to us; and helping us in any future dealings with you. It is your responsibility to inform us of any change in personal and contact data, including email address, telephone number and invoice address, by sending contacting us.
